UU Keimigrasian baru beri kemudahan bagi pemegang ITAS & ITAP karena kawin campuran

Rancangan Undang Undang Keimigarsian yang telah dipersiapkan sejak 2002 akhirnya disyahkan tanggal 7 April 2011 kemaren.

UU yang baru ini menggantikan UU keimigrasian No.9 tahun 1992, secara detail perumusan barunya adalah sebagai berikut :

  1. Leading Sector fungsi keimigrasian yang telah diletakkan di Kementerian Hukum dan HAM;
  2. Organisasi Direktorat Jenderal Imigrasi yang otonom;
  3. Penerapan Sistem Informasi Manajemen Keimigrasian sebagai penunjang pelaksanaan fungsi Keimigrasian dengan perangkat dan aplikasi teknologi informasi dan komunikasi;
  4. Penegasan bahwa setiap Warga Negara Indonesia tidak dapat ditolak masuk wilayah Indonesia;
  5. Pengaturan sterilisasi area Imigrasi di setiap Tempat Pemeriksaan Imigrasi di bandar udara, pelabuhan laut,dan pos lintas batas;
  6. Menteri Luar Negeri didelegasikan untuk mengatur hal yang terkait dengan paspor, visa dan izin tinggal untuk tugas diplomatik dan dinas;
  7. Pengaturan visa yang lebih jelas tujuan pemberian dan subjeknya;
  8. Pengaturan izin tinggal tetap yang diberikan untuk waktu yang tidak terbatas dengan tetap memiliki kewajiban melapor ke Kantor Imigrasi setiap 5 (lima) tahun dengan tidak dikenai biaya;
  9. Kemudahan bagi eks Warga Negara Indonesia dan eks subjek anak berkewarganegaraan ganda Republik Indonesia untuk memiliki Izin Tinggal Tetap;
  10. Kemudahan bagi pemegang Izin Tinggal Terbatas dan Izin Tinggal Tetap karena perkawinan campuran untuk melakukan pekerjaan dan/atau usaha untuk memenuhi kebutuhan hidup dan/atau keluarganya;
  11. Pengaturan penjamin sebagai pihak yang bertanggung jawab atas keberadaan dan kegiatan orang asing selama berada di wilayah Indonesia;
  12. Perluasan perspektif pengawasan keimigrasian yaitu pengawasan yang berbasis data dan informasi, pengawasan lapangan yang menyertakan tim pengawasan dari abdan atau instansi pemerintah terkait, serta penguatan fungsi intelijen Keimigrasian;
  13. Tindakan administratif Keimigrasian sebagai salah satu proses penegakan hukum di luar sistem peradilan;
  14. Rumah dan ruang detensi sebagai tempat penempatan sementara bagi orang asing yang melanggar peraturan perundang-undangan dan korban perdagangan orang dan penyelundupan manusia;
  15. Kewenangan preventif dan represif Menteri Hukum dan HAM dalam penanganan perdagangan orang dan penyelundupan manusia;
  16. Pencegahan dalam keadaan yang mendesak di mana pejabat yang berwenang dapat meminta secara langsung kepada pejabat Imigrasi di Tempat Pemeriksaan Keimigrasian;
  17. PPNS Keimigrasian diberi wewenang sebagai penyidik tindak pidana Keimigrasian;
  18. Ketentuan pidana yang mengatur kriminalisasi bagi penanggung jawab alat angkut, penjamin, pengurus, atau penanggung jawab penginapan, pelaku perdagangan orang dan penyelundupan manusia, pembuat maupun pengguna dan penyimpan dokumen keimigrasian palsu, pelaku perkawinan semu, deteni serta pejabat Imigrasi atau pejabat lain yang melakukan penyalahgunaan wewenang dan tidak melaksanakan tugas sesuai prosedur; dan
  19. Peningkatan kualitas Sumber Daya Manusia peserta pendidikan khusus Keimigrasian minimal sarjana.
  20. Komisi III DPR RI telah mengadakan rapat kerja dengan Menteri Hukum dan HAM dalam rangka pembicaraan tingkat I pada 31 Maret 2011 dengan agenda Laporan Ketua Panja kepada Pleno Komisi III, mengenai hasil pembahasan RUU tentang Keimigrasian, pendapat mini fraksi di mana seluruh fraksi menyatakan persetujuan dengan pengambilan keputusan, serta diakhiri dengan penandatanganan draft RUU. Untuk pasangan perkawinan campuran (WNI & WNA) dan anak hasil perkawinan campuran UU ini sangat menguntungkan (point 9 & 10) untuk kepentingan ijin tinggal dan bekerja.

Setelah 2 tahun usia pernikahan seorang pasangan WNA mendapatkan Ijin Tinggal Tetap (ITAP) sebelumnya akan diberikan Ijin Tinggal Terbatas (ITAS) dan tidak memerlukan Visa Kerja untuk dapat mencari nafkah dan menghidupi keluarganya di Indonesia.

Demikian juga dengan anak hasil perkawinan campuran jika setelah batas Duo Nationality* (18 tahun) memutuskan untuk berkewarganegaraan Asing, mereka mendapatkan ITAP dan bisa bekerja di Indonesia tanpa Ijin Kerja.

Dua point yang sangant membantu pasangan perkawinan campuran, paling tidak WNI pasangan WNA akhirnya mendapatkan hak yang sejajar dengan WNI lainnya, suami/ istri dapat bekerja dan tinggal dengan tenang dan layak.

Jadi ingat dulu sering dikeluhkan even sebelum duo nationality anak-anak yang lahir, dibesarkan di Indonesia, salah satu org tua bekewarganegaraan Indonesia, setelah menyelesaikan kuliah berkeinginan untuk bekerja di Indonesia (dgn niat sangat baik) di tolak untuk bekerja di Indonesia dan harus mengeluarkan berjuta juta untuk dapat tinggal di Indonesia, ironis rasanya dulu mendengar cerita mereka.

Ini adalah awal yang sangat baek.

Semoga Pemerintah dapat dengan segera mensosialisasikan dan semoga tidak ada pikah dengan kepentingan buruk memanfaatkan UU Keimigrasian Baru ini.

New Law for Mix Marriage

Happy to hear that all the hard work by “Tim Advokasi Perkawinan Campuran Indonesia” are finally paid.

One home work scratch, and we just wait for the implementation. Way to go.

The key points :

· If you marry an Indonesian citizen here, you will be entitled to Izin Tinggal Terbatas. After 2 years, you can convert it to Izin Tinggal Tetap (ITAP).

· If you have already been legally married for at least two years to an Indonesian citizen, you get an ITAP immediately. E.g. if you marry your Indonesian spouse in Australia and stay there for 2 years before coming to live in Indonesia, you are entitled to an ITAP immediately.

· If you have an ITAP because you are married to an Indonesian, you can work here without needing a work permit.

· If your children choose to keep their foreign nationality once they reach the age of 18, they are entitled to an ITAP and can work here.

· If your children were over 18 when the citizenship law was passed and never had Indonesian nationality, they are now entitled to an ITAP and can work.

· Foreigners who are legally married to Indonesians no longer need a `penjamin’ (sponsor).

· The ITAP is valid for an unlimited period but needs to be renewed administratively every 5 years. There is no cost for this.

· If you already have an ITAP and your Indonesian spouse dies, you keep the ITAP.

· If you have an ITAP and you and your Indonesian spouse divorce before you have been married for 10 years, the ITAP is cancelled.

· If you have an ITAP and you and your Indonesian spouse divorce when you have been married for 10 years or more, you keep the ITAP.

Unfortunately we still have to have the re-entry permit. If you have an ITAP, you will be able to get, as now, a multiple re-entry permit that is valid for 2 years.

Now that the bill has been approved by the DPR it will go to SetNeg and then be signed by the President. However, it will take some time before the implementing regulations are drawn up and this law becomes effective.

2010 High Light

Many things happens in a year, 2010 went by so quick and left us with lot’s things.

As Family we are getting stronger after bad business period of 2009, and the fact that we spent over 6 months in London, 2010 start fresh and happy family.

January & February, I spent only with Sophie as Sean have to finish the business things in London.

March, April & May are cuddles months, as we are back here in Bali, all of us.

Early June

Sophie start her playgroup at Bali Kiddy, exciting time as mommy I want to see her reaction and everything about it. The result was amusing day, happy day.

Sean Birthday, quite celebration just us.

Playgroup around Canggu

Kemaren Senin akhirnya kita nyempetin jalan jalan, looking for better school for Sophie Helen around our neighborhood .

Kenapa kita cari sekolah lagi buat Sophie (1.5 years old), karena sekolah yang sekarang Tumble Toots (WAS the only place except Sophie at her age 13 months).

1. lokasi Jauh di Renon, it take hour to get there and hours back.

2. The Class run for hour, which in our case karena perjalanan jauh, Sophie nyampe ditempat need about 15 menits untuk adjusting then left 45 minutes to play.

3. The method, TT using lot’s wood stuff for kids exercise, or train their walk, which i think work for Sophie in a way, but the fact that lot’s wood stuff lay down on the floor make me as parent feel unsafe, meaning, Sophie can not run a round by her self without me or her Nanny follow her, meaning all activity have to be guard.

4. No safe soft play area

5. No outdoor play are

I am not saying that Sophie not have a good time, in fact TT encourage Sophie to walk, pertama kali join TT Sophie was crawling & cruising, she walk only 5 step but since arrive in Bali she wont do it at all, then she saw all her friend ( walking to 2 Class at TT) was mostly walking, I think that help her,  2 weeks after that Sophie was walk.

Chubbawubba Shop Bali, TOYS SHOP

Sophie Helen sekarang sudah 17 bulan, time indeed just flies, rasanya baru kemaren sibuk nyiapin semua keperluan kelahiran Sophie, eh sekarang…sibuk juga sich cuman beda sibuknya…sibuk cari mainan, hehe.

Hidup di Bali, part of it is lovely being close to the beach and relax life rytem, but when we talking about shopping for little one, or even big one, it’s bit annoying.

Put it this way, to gather all the stuff for Sophie birth, I have to shop from about 6 different shop, not include the 3/4 online shop from Jakarta.

Here some list Baby Shop in Bali :

1. NIKITA baby shop, Gatot Subroto

2. Ceria baby shop, Gatot Subroto

3. Clandys, bulu Indah

4. Hello Kitty, Diponegoro Denpasar

5. Balonku, Pertokoan Udayana Denpasar

You can also find some stuff from Carrefour and Hypermart.

For Toys, it’s bit imposibble really, eaither you get normal, not safe stuff or good but tier our pocket, so other way you cant win.

Some stuff I manage to get from Balonku and Toy r  Us, but eveyrthing else are online shop from Jakarta. Which even after calculate shipping cost some price still low then buy here, Im not just talking about small easy stuff but branded toys, like Fisher Price, Vtech, Einsten, etc.

For that reason, I feel why not make an online shopping for mom here in Bali, I had the conection with good price and trust able quality for branded or non branded toys.

Welcome Mother Care Bali

Should i said Finally? hem…not really but yeach finally, nice decend stuff from mother care which I been hunt since Sophie still in my tummy, now they open branch here in Bali at Discovery shopping Mall.

We went there last weekend, they took 1 shop, which i think enough.

We was wondering half hoping that they will work with some local branded stuff so the price wont be Pounsterling covert Rupiah calculation, but they dont.

All items are imported from UK after they brought from China..hehehe, so price still expensive.

Anyway, they you go, if looking for nice items with good quality and safe guarantee.
